Terms and Conditions

These terms apply to your use of https://exchange-rooms.com and to any account you create on it. By creating an account you agree to them. If you do not agree, please do not use the platform.

Exchange Rooms is run by Thomas Vervoort, Eenmanszaak, De Nieuwe Erven 3, Unit 14805, 5431 NV Cuijk, Netherlands, registered at the Kamer van Koophandel under number 42051964. In these terms, "we" and "us" mean Exchange Rooms, and "you" means the person using it.

1. What Exchange Rooms is

Exchange Rooms is a platform where exchange students advertise a room they have available and find a room at their exchange destination. We run the website, the database and the messaging between members.

We are not an estate agent and we are not a party to any sublet. We do not inspect rooms, we do not verify listings, we do not draw up or sign sublet agreements, and we do not handle rent or deposits. Everything that happens after two members find each other is between those members.

2. Who may use it

You may use Exchange Rooms if you are 18 or over and are, or are about to become, an exchange student. You need an account to advertise a room or to contact another member.

You are responsible for the details you give us being accurate, for keeping your login credentials to yourself, and for everything that happens under your account. Tell us as soon as possible if you think someone else has access to it.

One person, one account.

3. Listings

If you advertise a room, you are responsible for the listing being truthful: the description, the photographs, the location, the price and the period it is available.

Check whether you are allowed to sublet before you advertise. Whether you may depends on your own tenancy agreement and on local housing law, and it is your responsibility to find out. We cannot advise you on it.

You keep the rights to the photographs and text you upload. By publishing them you give us permission to display them on the platform for as long as your listing exists, and nothing beyond that.

4. Contacting other members

Reading the platform is free. Sending messages requires a one-time payment, described in clause 5.

Contact details — email addresses, phone numbers and social media handles — belong in the chat, not in your profile, your listing or any other public field. We remove them where we find them, because publishing them defeats the point of the chat and exposes members to unsolicited contact.

5. The one-time contribution

Unlocking the chat costs €4,99, paid once. There is no subscription and there is no recurring charge. Once unlocked, your access to the chat does not expire.

Payment is handled by Stripe. We never see or store your card details.

Right of withdrawal. Because this is a digital service delivered immediately, you will be asked, at the moment you pay, to expressly request that we start straight away and to acknowledge that doing so means you lose your 14-day right of withdrawal. If you do not agree to that, do not complete the payment.

If the chat does not work for reasons on our side and we cannot fix it, contact us and we will refund you.

6. What you may not do

  • Post anything false, misleading, offensive, discriminatory or unlawful.
  • Advertise a room you do not have, or a room you are not permitted to sublet.
  • Harass, threaten or spam other members.
  • Use the platform to advertise anything other than a room for sublet.
  • Scrape, copy or bulk-collect listings or member data, by hand or automatically.
  • Try to get around the payment, the security of the platform, or any limit we have set.
  • Impersonate somebody else.

7. Removing content and closing accounts

We may remove a listing or a message, or suspend or close an account, if it breaks these terms or if we have good reason to think it is fraudulent or harmful to other members. Where it is reasonable to do so we will tell you why first.

You can close your account yourself at any time. Doing so removes your profile, your listing and your messages. The one-time contribution is not refunded when you close your account voluntarily.

8. Availability

We do our best to keep the platform running, but we do not promise it will always be available or free of errors. We may change, suspend or discontinue parts of it. If we discontinue the platform entirely, we will give members reasonable notice.

9. Liability

Nothing here excludes liability that cannot be excluded by law, including liability for intent or gross negligence.

Beyond that: we are not liable for any agreement between members, for the condition or existence of a room, for anything a member says or does, or for any loss arising from a sublet. Our liability towards you is limited to the amount you have paid us.

10. Privacy

How we handle your personal data is set out in our privacy statement and our cookie policy.

11. Changes to these terms

We may change these terms. Each version carries a version number and a date, shown at the top of this page. If a change is material we will tell you, and you will be asked to accept the new version. The version you accepted is the one that applies to you until you accept a newer one.

12. Applicable law

Dutch law applies. Disputes go to the competent court in the Netherlands, unless mandatory consumer law entitles you to bring them somewhere else.

If you have a complaint, please contact us first. We would rather sort it out directly.
